This signed agreement is acknowledgment from the parent signing this form below has completely read & understand what is expected of me, my family and my child participating on the Fort Lauderdale Stars Gymnastics Team. I further agree to abide by and follow the Team Rules/Policies and all the information set here in this packet prepared by Fort Lauderdale Stars. Fort Lauderdale Stars Warning of Risk & Insurance Responsibility: associated with the sport of gymnastics, tumbling, or cheerleading. I recognize that potentially severe injuries can occur in any activity involving height or motion, including gymnastics, tumbling, and related activities including cheerleading, tumble tramp, trampoline, stunting, pyramids, dance, gymnastic activities, camps, games, contests, and physical activity in general. I recognize that students may suffer injuries, possibly minor, serious, and catastrophic in nature or even death in sports or activities involving height or motion. Parents should make their children aware of the possibility of injury and encourage their children to follow all the safety rules and the coach's instructions. Fort Lauderdale Stars, its coaches, and other staff members will not accept responsibility for injuries sustained by any student or parent during the course of gymnastics, tumbling and cheerleading instruction, or open workouts, or in the course of an exhibition, competition, birthday parties or clinic in which he or she may participate in. With the above in mind, and being fully aware of the risks and possibility of injury involved, I consent to have my child or children participate in programs offered by Fort Lauderdale Stars Inc. I, my executors or other representatives, waive and release all rights and claims for personal injury or property damage that I or my child may have against Fort Lauderdale Stars Inc. and or its representative whether paid or volunteer. I hereby COVENANT NOT TO SUE and FOREVER RELEASE this facility, affiliated and partner companies and organizations, property owners and lessors, staff, contractors, subcontractors, teachers, and coaches involved in this facility program, from all liability and for any and all damages and injuries suffered by myself or child during instruction, supervision, and/or control during any and all classes. Any insurance protection must be obtained by the participant and guardian. Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, Covid-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Fort Lauderdale Stars has put in place preventative measures to reduce the spread of COVID-19; however, Fort Lauderdale Stars cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending programs, classes, and camps at our facility could increase your risk and your child(ren)’s a risk of contracting COVID-19. By signing/digitally signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending programs, classes, and camps at Fort Lauderdale Stars and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Fort Lauderdale Stars may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Fort Lauderdale Stars or participation in programs, classes and camps (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Fort Lauderdale Stars, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Fort Lauderdale Stars, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Fort Lauderdale Stars programs, classes, and camps. Photo release: I also grant Fort Lauderdale Stars to use photographs of myself or the participant(s) for publicity purposes.
